Refund & Design Guarantee Policy

At Nirmithya, we stand behind our design work. Our promise is simple: if you don’t love your home design, you don’t pay. This Policy explains exactly how that guarantee works, when it applies, and how to request a refund. This Policy should be read together with your written proposal and/or Service Agreement; in the event of any conflict, the Service Agreement prevails.

1. Scope of the Guarantee

The design guarantee applies only to Phase 1 of our design process — the development of your floor plan and elevation. It does not apply to subsequent phases (such as detailed working drawings, structural, electrical, plumbing, and drainage drawings, the BOQ, site visits, or any other later-stage deliverables), which are non-refundable once commenced or delivered.

2. The Revision Process

We work collaboratively to get your design right. During Phase 1, you are entitled to three (3) rounds of revisions for the floor plan and three (3) rounds of revisions for the elevation.

For each revision round, you must send us, by email or WhatsApp, a clear written description of what you like and what you would like changed. This written feedback is what allows us to revise the design and is also required as proof if you later request a refund.

3. When You Can Request a Refund

You may request a refund under the design guarantee only if all of the following conditions are met:

You have completed all three (3) revision rounds for the relevant category (floor plan or elevation), with written feedback provided for each round; and

After the third revision of that category, you are still not satisfied with the design; and

You submit your refund request within thirty (30) days of delivery of the third (final) revision of that category; and

You send your request by email to [email protected], attaching the written feedback / proof from your revision rounds.

4. When the Guarantee No Longer Applies

The design guarantee ends, and the right to a refund is forfeited, once you confirm and approve your floor plan and elevation and proceed to the next stage of the engagement. By confirming and approving the floor plan and elevation, you acknowledge that you are satisfied with the Phase 1 design and waive the refund right described in this Policy.

5. What Is Refunded

If your refund request meets all the conditions in Section 3, we will refund the amounts you have paid for Phase 1, less a non-refundable deduction of ₹15,000 (Rupees Fifteen Thousand only) towards the processing fee and site survey fee already incurred on your behalf.

Refunds are made to the original payment method or by bank transfer, normally within fifteen (15) business days of our approving the request. Any applicable taxes will be handled in accordance with law.

6. Effect of a Refund on the Designs

If a refund is issued, you immediately and entirely forfeit any right to use the designs, drawings, plans, and renders prepared for you. All intellectual property in those designs remains with Nirmithya, and you may not use, copy, share, or build from them in any manner. Continuing to use any such design after a refund constitutes a breach of this Policy and of our Terms & Conditions.

7. Important Notes

This guarantee covers your satisfaction with the Phase 1 design only. It does not cover construction, contractors, materials, statutory approvals, or rental-income outcomes, none of which we control or guarantee.

Refunds will not be granted where the conditions in Section 3 are not met, where written feedback was not provided for each revision round, or where the floor plan and elevation have been confirmed and approved.

The detailed payment terms applicable to your engagement are set out in your written proposal and/or Service Agreement.

8. How to Request a Refund

Send an email to [email protected] with the subject line “Refund Request – [Your Name]”, attaching your written revision feedback / proof. We will acknowledge your request and respond within the timelines set out above.
